Why are you penalized for leveling on NPCs that are higher level than you?

If point 3 is actually possible (i.e. to hard code the level check in the instance itself rather than in the party) then something along the lines of this is basically how I would want it to be, I think.
I'm no programmer but I can't see it being that hard just need a check to see if the monster is aggro/ in combat with another character. If yes, a check to see if their level is <10 levels above. If yes, 0 exp! If no 100% exp.
