Good mechanic, a lot better than giving it a flat bonus chance (let alone guaranteed crits)--I'm hoping there are new affixes to accompany diamond flasks such as bonus life leech on physical crit, and potentially new ones like physical crits pieces through all armour and cripples movement speed, and a chance to psuedo-culling strike on crit if enemy is below x% hp (maybe giving you a charge).

On the subject of flasks, has there been any consideration to make elemental resist flasks more attractive beyond very niche situations?

And I feel this is becoming a pertinent issue--could there be an affix to let potions gain charge(s) even when a party member makes the killing blow? It's difficult to manage as a non-DPS character or when someone has culling strike.

in this game, having 9%/16% extra crit chance is not considered useless, actually people spend from 5-15 pasive nodes into achieving what you are calling useless

Uh. 2 seconds? You'd better be planning your crit strikes very well. Let's hope the "we're still balancing how long the flask lasts" means "we will be increasing how long the flask lasts before we release it" otherwise this will be another of those flasks like the resistance flasks that gets vendored.
