Yesterday's legacy migration, 0.9.12r patch and upcoming 0.9.12s patch

What happens to characters that were already in legacy league before migration? Are they deleted, or are they merged with the new influx of characters from default to legacy?

I'm curious because I've wanted a specific name for months, and it's always been reserved on a level 1 legacy character.
