Most likely they will rebalance act 4 to be easier, and make act 5 around the same difficulty as act 4 is now. Act 4 merciless is intended to be an alternative end-game zone, although I don't think many people are actually using it like that.

Btw, expect the new bosses in act 5 to be overtuned on release, this is because it is easier to start too strong and tune down, than start too easy and tune up. No matter what, people will complain it's either too easy or to hard, depending.

History would definitely indicate there will be many complaints about the boss being too hard. At the same time I suspect that they will nerf Malachai a bit, at least based on history.
