Good question...
I assume you will have to delete your character, because the name will still be in use.
When a hardcore character dies, the character stays intact but gets moved to a different league (Hardcore -> Default). Even though they're in different leagues, the name cannot be re-used in this instance (can't have Hardcore and Default characters with the same name).
I assume the same will apply as your character simply will get moved from Default -> "Legacy" league.

You can still make characters in the Legacy league if you want to play there.
