Apostate Seething fury jewel interaction

Today i equipped apostate and emperors vigilance (500 ES shield) to leverage the ES into life pool on my SST build.

To my surprise seething fury did nothing to my crit values in game.
i logged in and out and resocketed stuff.
Then it hit me that with apostate you gain no ES from shield

but the wording on jewel specifically mentions value of shield doesnt it?

+0.15% to Off Hand Critical Strike Chance per 10 Maximum Energy Shield on Shield
+4% to Off Hand Critical Strike Multiplier per 10 Maximum Energy Shield on Shield

This is the wording on apostate:

"

Gain Maximum Life instead of Maximum Energy Shield from Equipped Armour Items

I thought its gonna count and jewel would just pull the ES values from shield slot and ignore everything else. Similarly that the "defenses from equipped shield" stat does nothing towards SST or seething fury jewel.
Shouldnt that also mean that mods that disable ES altogheter would disable seething fury aswell?

Is this intended behaviour?
