Console - Unable to use passive skill refund points

I'm playing on xbox and I have refund points available but I'm unable to use them. I've attempted to reset the game and console. I've attempted to use them at various allocated points on the skill tree, nothing.

Same thing is happening to me. I'm on Xbox also. I press Y while on the passives screen and nothing happens.

I found that I can only refund using the "respecialisation" in the new town. I can refund with gold but the 2 refund points I have available from quests are not working.
